In response to the growing threats posed by illegal activities that disrupt the orderly exploitation of mineral resources, the Ministry of Land and Resources has issued an urgent notice to provincial land and resources departments. This follows the State Council's directive to comprehensively regulate and standardize the development of mineral resources. The notice emphasizes a swift and effective crackdown on illegal mining practices, particularly in key sectors such as rare earths, oil, gas, graphite, iron, and gold—areas where the management of resource development has been especially problematic. The "Notice" outlines three main tasks to be completed before the end of 2005. First, it calls for a thorough investigation into all forms of illegal mineral exploitation. Any unlicensed mining operations must be reported to local authorities and immediately shut down. Those who fail to follow approved development plans or cause excessive waste will be required to suspend operations and face legal penalties. Unauthorized mining or the illegal transfer of mining rights will also be strictly addressed, with possible revocation of licenses if violations persist. Second, the notice mandates a comprehensive review of all mineral exploration projects. Projects failing to meet minimum exploration input requirements will be given a deadline to rectify their shortcomings. If not corrected, their exploration permits will be revoked. Those engaging in unauthorized or alternative exploration methods will have their illegal gains confiscated, and their permits will be canceled. Similarly, any illegal transfer of prospecting rights will result in fines and the revocation of licenses. Third, a full inventory of legal violations in the management of mineral resources is required. All cases involving unlawful approval of mining rights will be investigated. Individuals found involved in illegal mining activities will be suspended first and then dealt with according to regulations. To ensure compliance, the Ministry of Land and Resources will conduct regular inspections and establish a hotline for public reporting. In addition, efforts are underway to build a long-term regulatory framework for mineral resource management. New laws and regulations are expected to be introduced soon, aiming to strengthen the control over exploration and mining rights and further regulate the transfer of these rights to ensure sustainable and lawful resource development.
