In response to the growing threats posed by illegal activities that disrupt the orderly exploitation of mineral resources, the Ministry of Land and Resources has issued an urgent notice to provincial land and resources departments. This follows the State Council's directive to fully regulate and standardize the development of mineral resources. The notice emphasizes the need for swift action, focusing on three key investigations aimed at curbing unlawful mining practices.
First, a thorough investigation into all illegal mineral exploitation is required. Any unlicensed mining operations must be reported to local authorities and immediately shut down. Those failing to comply with approved development plans and causing significant waste or damage to resources will be ordered to halt production and face legal penalties. Unauthorized mining or illegal transfer of mining rights must be rectified, and in severe cases, operations may be suspended until permits are revoked.
Second, a comprehensive review of all mineral exploration projects is mandated. Projects that fail to meet minimum exploration investment requirements will be given a deadline to correct their shortcomings. If not addressed, their exploration permits will be revoked. Any use of alternative or unauthorized exploration methods will result in confiscation of illegal gains and revocation of permits. Similarly, any illegal transfer of prospecting rights will lead to fines, confiscation of profits, and permit revocation.
Third, a detailed audit of violations in the management of mineral resources is required. All cases of regulatory breaches or improper approval of mining rights will be investigated. Individuals found involved in illegal mining activities will be first dismissed from their positions and then dealt with according to relevant regulations.
The notice mandates that these three initiatives be completed by the end of 2005. The Ministry will supervise the implementation across regions and set up a hotline for public reporting. In addition, efforts are underway to establish a long-term mechanism for managing mineral resources, with supporting guidelines being developed.
